OFFICIAL SWEEPSTAKES RULES

 

THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PARTICIPATION IN THE UNITED STATES ONLY.  PLEASE DO NOT SUBMIT AN ENTRY IF YOU DO NOT MEET THE ELIGIBILITY REQUIREMENTS LISTED IN THE “ELIGIBILITY” SECTION BELOW.

 

*NO PURCHASE OR SURVEY PARTICIPATION NECESSARY TO ENTER OR WIN. A PURCHASE OR SURVEY PARTICIPATION WILL NOT IMPROVE YOUR CHANCE OF WINNING A PRIZE.

 

1.     DATES OF PROMOTION:  The “Discover Student Loan Awareness Survey Sweepstakes” (the “Sweepstakes”) begins at 3:00 p.m. Eastern Time (“ET”) on September 25, 2012 and ends at 11:59 p.m. ET on October 8, 2012 (the “Sweepstakes Period”).

 

2.     ELIGIBILITY: The Sweepstakes is open only to recipients of the Invitation (defined below) who must also be; (a) a Discover cardholder prior to September 25, 2012; (b) a permanent legal resident of one of the fifty (50) United States or the District of Columbia; and (c) at least eighteen (18) years of age or older at time of entry (the “Entrant”).  Entrants must have Internet access and an established email address as of September 25, 2012 to be eligible to participate in the Sweepstakes via the Online Survey entry method as further defined below. The Entrant who is selected as the potential prize winner (the “Prize Winner”) must have a unique, personal and valid social security number for Sponsor (defined below) to report the tax liability associated with acceptance of the respective prize.  Valid social security numbers will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “Prize Claims” Section of these official rules.  Officers, directors, managers and employees of Discover Products Inc. (the “Sponsor”), Millward Brown and it’s client(s), and each of their respective parents, subsidiaries, affiliates and related companies, dealers, advertising and promotion agencies, including companies providing marketing and market research services to Sponsor or its client(s), consultants and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such person, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including National Sweepstakes Company, LLC (the “Independent Administrator”), are not eligible to participate. Sweepstakes is void in Puerto Rico, US territories and possessions located outside the fifty (50) United States and the District of Columbia, and where ever else restricted or prohibited by law. 

 

3.     HOW TO ENTER:  There are two (2) ways to enter the Sweepstakes as outlined below.  Invitations to participate in the online survey (the “Survey”) will be provided to potential Entrants via email (the “Invitation”).  Regardless of the method in which you choose to enter the Sweepstakes, either by participating in the Survey or via the Alternate Method of Entry (the “AMOE”), all Entrants must utilize or provide the unique survey URL address found in his/her Invitation at time of entry .

 

a.     Online Survey: To enter the Sweepstakes by taking the Survey, visit the unique Survey URL (the “Website”) during the Sweepstakes Period, which can be found in your Invitation.  Then, complete the Survey in its entirety, by submitting your answers to the Survey questions, in order to automatically receive one (1) entry into the Sweepstakes. In order to be eligible and receive your entry into the Sweepstakes, you must complete the entire Survey.  If you do not complete the Survey, or if you complete the Survey and click the “I do not wish to be entered into this Sweepstakes” button, you will not receive an entry into the Sweepstakes, and therefore will not be eligible to win a prize. 

b.    Alternate Method of Entry (“AMOE”):  To enter the Sweepstakes without taking the Survey, you may enter by mail as follows:  On a plain 3” x 5” card, legibly handprint or type your first name, last name, complete address, city, state, zip code, telephone number (including area code), date of birth and email address (if available), along with the unique Survey URL found within the Invitation you received[*], and mail your 3” x 5” card in a business size envelope to: “Discover Student Loan Awareness Sweepstakes”, 90 Rockwood Place, Rochester, New York 14610.  AMOE entries must be postmarked by October 8, 2012 and received by October 15, 2012 to be eligible for the Sweepstakes.  Each envelope is considered one (1) entry into the Sweepstakes.  Multiple entries submitted by a single Entrant or in the same envelope are void.  Entries submitted or completed by anyone other than the Entrant are void.  No mechanical reproductions will be accepted. *The unique Survey URL found within the Invitation you received is required to identify the Sweepstakes you have entered.  AMOE entries that do not include the unique Survey URL found within his/her Invitation will not be considered eligible and will be void.

 

Regardless of the method chosen to participate in the Sweepstakes, either by taking the Online Survey or via the AMOE, there is a limit of one (1) entry per person during the Sweepstakes Period.  Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different email addresses, and /or any other methods will void that Entrant’s entries and that Entrant may be disqualified from the Sweepstakes.  In the event of a dispute regarding the identity of an Entrant entering online by taking the Survey, the entry will be assigned to the authorized account holder of the Entrant’s Discover Account.  “Authorized account holder” is defined as the natural person who is assigned to the Discover Account by the Sponsor.  Potential Prize Winners may be required to show proof of being the authorized account holder.  Entries submitted by anyone other than the Entrant are void.  Neither the Sponsor, nor Independent Administrator will verify receipt of entries for Entrants.  All entries submitted become the sole property of Sponsor and will not be returned.  Sponsor is not responsible for lost, late, misdirected, illegible, damaged or postage-due mailed entries.

 

4.     WINNING/NOTIFICATION:  On or about October 29, 2012, one (1) Prize Winner will be selected in a random drawing conducted from among all eligible entries received during the Sweepstakes Period.  The random drawing will be conducted by the Independent Administrator, whose decisions are based upon their sole discretion and interpretation of these official rules, and are final and binding in all respects. Odds of being selected as the Prize Winner will depend upon the total number of eligible entries received during the Sweepstakes Period.  Potential Prize Winner will be notified by the Sponsor via telephone between the hours of 8:30 a.m. ET and 5:00 p.m. ET immediately following each drawing.  Potential Prize Winner will be required to supply and/or confirm his/her full name, mailing address, city, state, zip code and date of birth for verification and delivery of the Prize.  Potential prize winning notifications will not be left on answering machines.  The Sponsor will make up to three (3) attempts to notify a potential Prize Winner. In the event the Sponsor cannot reach a potential Prize Winner via the telephone notification, or if it is determined by Sponsor, in their sole discretion, that the potential Prize Winner is not eligible in accordance with these official rules, an alternate Prize Winner will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period and he/she will be notified as outlined above.  Once verified, each potential Prize Winner must also sign and return “Required Documents” as outlined in the “Prize Claims” section below.

 

5.     PRIZE CLAIMS:  Except where prohibited, potential Prize Winner must sign and return within seven (7) business days of receipt, an affidavit of eligibility/liability/publicity release (the “Release”) and an IRS Form W-9 in order to claim his/her Prize (collectively, the “Required Documents”).  If potential Prize Winner fails to return the Required Documents within seven (7) business days of receiving it, potential Prize Winner forfeits his/her right to the respective Prize and another winner will be selected at random from among the remaining non-winning eligible entries received. Potential Prize Winner must report income to the IRS.  In the event it is deemed during the verification process that potential Prize Winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the respective Prize, potential Prize Winner will be disqualified and another winner selected from among the remaining non-winning eligible entries received during the Sweepstakes Period.  Valid social security numbers will be determined by IRS requirements.  Prize Winner consents (and agrees to sign any additional documents required by Sponsor to formalize, effect or perfect such consent) to Sponsor’s use of his/her name, likeness (photograph and/or video), biographical information, and voices in advertising/publicity/trade without compensation, notice or approval; and, Prize Winner disclaims any ownership rights of such advertising/publicity/trade material (TN residents will not be required to sign a publicity release as a condition of winning a prize). The Prize will be awarded within six (6) to eight (8) weeks from the date in which the Required Documents are received.

 

6.     PRIZE(S):  One (1) prize of $1,000 will be awarded (the “Prize”) to the Prize Winner. Prize will be awarded to the Prize Winner in the form of two (2) $500 Discover Gift Cards or as $1,000 cash in the form of a check as determined by Sponsor in its sole discretion. The approximate retail value (the “ARV”) of the Prize is $1,000.00.  Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor and is subject to the terms of the conditions of the Discover Gift Cards. Prize cannot be substituted, assigned, or transferred; except at Sponsor’s sole discretion or as otherwise provided herein.  Sponsor will not replace any lost or stolen Prize.  The Prize is taxable as income and the Prize Winner is solely responsible for all applicable federal, state and local taxes. No more than the stated number of Prizes set forth in these official Sweepstakes rules will be awarded.  All Prizes will be awarded.

7.     GENERAL CONDITIONS:  Should any portion of the Sweepstakes be, in Sponsor’s  sole discretion, compromised by non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules.  Notice of such action by Sponsor will be posted at the Website.  In such event, Sponsor reserves the right to award the prize(s) at random from among the eligible entries received up to the time of the impairment.  Sponsor reserves the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry.  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

 

8.     RELEASE: By participating in this Sweepstakes, Entrants agree to release and hold harmless Sponsor, Millward Brown and it’s client(s), and each of their parent companies, respective officers, directors, managers, employees, subsidiaries, affiliated entities, agents, members, shareholders, insurers, servants, guests, divisions, predecessors, successors, representatives, assigns, attorneys, dealers, distributors, advertising, promotion, and fulfillment agencies, including the Independent Administrator, (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, redemption or use of any prize.

 

9.     LIMITATIONS OF LIABILITY:  The Released Parties do not have any responsibility or liability whatsoever for: (a); unauthorized human intervention in any part of the entry process or the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c)  any property loss, damage, personal injury, or death, in connection with the prizes provided pursuant to this Sweepstakes and/or any person’s participating in the Sweepstakes;  (d) any printing or typographical errors in any Sweepstakes-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, damaged or indecipherable entries; or (vi) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (if applicable). 

 

10.  ENTRANTS’ PERSONAL INFORMATION: During the online Survey, Sponsor will be collecting non-personally identifiable data about Entrants.  Sponsor will also collect each Entrant’s first name, last name, address, city, state, zip code, telephone number, date of birth and email address, solely for the purposes of confirming the eligibility of such Entrant, notifying a potential Prize winner and awarding a Prize, and reporting winner information as required by law (as applicable), if Entrant is selected as a Prize Winner.  All other information collected from Entrants (including but not limited to the Entrant’s gender and any other demographic information) is collected for analysis purposes only.  Information collected from Entrants is subject to Sponsor’s privacy policies, located at http://www.discovercard.com/customer-service/privacy-policies/ and Millward Brown’s privacy policy located at http://webfarm.ktrmr.com/w3c/survey_policy.htm

 

11.  WINNER’S LIST/RULES REQUEST: For the name of the Prize Winner or a copy of these Official Rules, please submit a self-addressed, stamped envelope by November 30, 2012 to “Discover Student Loan Awareness Sweepstakes” (please specific “Winner’s List” or “Rules Request”), PO Box 10505, Rochester, NY 14610.   A copy of these Official Rules may also be obtained at the Website during the Sweepstakes Period.

 

12.  SPONSOR:  Discover Products Inc., 2500 Lake Cook Road, Riverwoods, IL  60015. This offer shall not be published without the written permission of the Sponsor.
